AUGUSTA, GA (WFXG) -

A Richmond County Grand Jury has indicted the parents of a four-year-old boy who shot himself with a gun on Saturday, July 7, 2018.

According to the report from the Richmond County Sheriff's Office, around 10:49 Saturday morning, Justin Foss, Jr. found one of his parents' guns that was hidden under the couch of his home at Millbrook Pointe Apartments.

He accidentally shot himself in the head with that Smith and Wesson, according to the Richmond County Sheriff's Office's case report. 

He was pronounced dead at Augusta University shortly after the shooting occurred.

Court documents obtained by FOX 54 state the indictments for Justin Foss  include:

  • 1 count of felony murder
  • 1 count of murder in the second degree
  • 1 count of cruelty to children in the second degree
  • 1 count of possession of a firearm by a convicted felon

Shelby Foss is being charged with the following:

  • 1 count of murder in the second degree
  • 1 count of cruelty to children in the second degree

Justin Foss, Sr.  was denied bond yesterday and remains in jail.

Both parents are in custody and are being booked for the Grand Jury Arrest Warrants.
