CINCINNATI, OH (FOX19) -

A decision was made Friday for Damon Kirkendall who was indicted in February and accused of killing a Mount Healthy track star.

Judge Melba Marsh found Kirkendall not guilty in the death of 19-year-old Vince Turnage.

Judge Marsh's ruling says that eye witness testimony was not substantial for the case.

Turnage was murdered last November in a home invasion at his Springfield Township home.
