AUGUSTA, GA (WFXG) - A mother whose 2-year-old son died earlier this month is now charged with second-degree murder, according to the Richmond County Sheriff's Office.
Mary Katherine Smith was originally charged with second-degree cruelty to children after her son, Mason Tucker Smith, died at Georgia Regents Children's Medical Center.
The charge was upgraded on Wednesday, according to the sheriff's office.
Deputies were called to the hospital on the morning of Aug. 1. Smith told police she sent her son to the corner for disciplinary reasons. After she left the room, she heard a noise and when she returned, she found him on the floor.
Smith also told deputies that Mason had a syndrome that caused him to hold his breath until he lost consciousness.
