Lawsuit filed to stop Tell City Annexation

Tell City's annexation plans have officially been put on hold now that the Perry County Citizens Against Annexation have filed a lawsuit.

The group says they believe they have a strong enough backing to take the battle to court.

In January, City Council adopted a plan to annex just over 1,700-acres of land. The council approved it in April.

Since then the Citizens Against Annexation have organized a petition, they say has received enough signatures to file the annexation remonstration.

The group's Joe Meyer says they've hired Indianapolis Attorney Stephen Buschmann.

Meyer says Buschmann and the city's attorneys are now in the process of reviewing and validating the petition's signatures.

"They look at the names, see which names are good, which names are bad," said Meyer. "They try to knock out names. Then if all the names are good, if we have the numbers, which I think we do, then we go to court. We don't see how the City can afford to do this. We don't have a tax base to pay for this. The mayor says if we don't do this, the city is going to die. If the city does this, it's going to die. If this is the only thing saving Tell City, then it's in pretty bad shape."

A timeline has not yet been set for when this could go to court.
