Vandy rape suspect's attorney disputes allegations

NASHVILLE, TN (WSMV) -

There is another twist in the case of an alleged rape on the Vanderbilt University campus. Some of the most disturbing allegations yet are coming out, and they're pitting the suspects against one another.

The attorney for suspect Cory Batey, Worrick Robinson, says fellow suspect Brandon Vandenburg told police Batey made a racial comment while urinating on the unconscious victim. But, in an exclusive interview with the Channel 4 I-Team, Robinson says those are all lies released in an effort to ensure his client can't get a fair trial.

"It was provided with the intent to destroy the other three defendants, destroy their credibility in the public eye and to serve and aid one person only," said Robinson.

Batey is accused of participating in a sexual assault of an unconscious classmate in a dorm room last summer along with three of his then-teammates on the Vanderbilt football team: Vandenburg, Jaborian McKenzie and Brandon Banks.

But, Robinson says, allegations Vandenburg made to police in the early days of the investigation that were recently made public aren't true.

"He didn't do it. He did not do it," said Robinson. "The allegations that Mr. Batey would have urinated on this young lady, the allegation that he would have used some type of racial slur with this young lady are tremendous allegations."

Robinson says the other two suspects, Banks and McKenzie, contradicted Vandenburg's claims to police about Batey. And, he says, police found no physical evidence of urination in the dorm room.

Robinson says he will likely seek not only a separate trial for Batey, but he may also ask to have the trial moved out of Nashville because police records were made public.

"Now, where are we gonna go to find 13 individuals that can sit there that haven't heard this, haven't paid attention to this? I don't know where you're gonna go to find those people, so my client's ability to get a fair trial has been totally wrecked," said Robinson.

Vandenburg's attorney, John Herbison, told the Channel 4 I-Team on Tuesday his team plans to file a motion to keep a jury from hearing what Vandenburg told police. It's anticipated this back-and-forth will continue until the case moves to trial in August.
