John Goodman case:defense attorneys to ask judge to delay trial

WEST PALM BEACH, FL (WFLX)-- The 2007 Bentley Continental GTC driven by International Polo Club founder John Goodman the night University of Central Florida student Scott Wilson was killed will be examined by an expert in Texas, defense attorney Douglas Duncan told 15th Judicial Circuit Chief Judge Jeffrey Colbath on Tuesday.

During an early-morning hearing at the Palm Beach County Courthouse, Duncan also told Colbath that he would ask him to delay the start of the upcoming re-trial on DUI manslaughter and vehicular manslaughter charges and issue a gag order to prohibit attorneys and witnesses from speaking about the case with members of the media.

Colbath said he would consider those and other matters during a hearing on December 2nd.

The hearing came hours after defense attorneys alleged that prosecutors withheld information about vehicle malfunctions similar to the one argued during the 2012 trial that ended with Goodman being convicted of DUI manslaughter.

"[Prosecutors] argued that because the vehicle was a "quarter of a million dollar" vehicle, it was ludicrous for the defense to argue that the vehicle could have malfunctioned," defense attorneys wrote in their motion.

The premise of a vehicle malfunction had been a central focus of Goodman's defense.

Goodman remains on house arrest.

A date for a new trial had been expected to be scheduled on January 17th.
