PHOENIX (CBS5) -

A 3-year-old child died Monday morning from injuries suffered in a head-on collision over the weekend, Phoenix police said.

The driver of the other vehicle, 19-year-old Edgar Martinez, exhibited symptoms of marijuana use and could be charged with manslaughter, according to a court document released Monday afternoon.

The family of Eric Garces was with him when he passed away, said Phoenix police Sgt. Steve Martos. Eric had suffered a twisted and stretched spinal cord, court paperwork stated.

Two other children, ages 5 and 11, were hurt and are recovering in a local hospital.

Police said Martinez hit the car the kids were riding in Saturday night as he attempted to pass another vehicle and lost control. Martinez's car rolled over following the collision.

An adult male in the car with the kids was taken to the hospital, Martos said. 

Officials said two people inside Martinez's vehicle were also rushed to local hospitals.

The crash occurred near 31st Avenue and Acoma.

Martinez was initially booked into the Maricopa County Fourth Avenue Jail on four counts of aggravated assault and one count of endangerment.

A reconstruction of the accident is ongoing as police continue their investigation. Officers said it appeared Martinez was speeding at the time of the crash.
