Thomson plane crash victims' families file lawsuits

THOMSON, GA (WFXG) -

Four of the families of the victims who died in the Thompson plane crash about seven months ago have filed lawsuits.

In February a small, private jet hit a utility pole and crashed. All five passengers were killed and the two pilots were injured.

The victims all worked for the Vein Guys and they were returning from surgery practice in Tennessee.

Now all but one of the families has filed civil suits.

The families of Lisa Volpitto, Heidi McCorkle, Tiffany Porter and Kim Davidson filed lawsuits that claim their deaths could have been avoided if it wasn't for the negligence of a dozen parties.

The Davidson, Porter and McCorkle families are suing pilots Richard Trammell and Jeremy Hayden and the group that owned the plane, Pavilion Group Llc.

According to lawsuits obtained by Fox54, the pilots were "impaired, or unqualified." 

The lawsuits say the Pavilion Group and one of the victims of the crash, Dr. Steven Roth, who employed the other victims, allowed the "inadequately trained" pilots to operate the jet.

Mary Roth, Steven's widow, is named as a defendant as the executor of his estate. 

The four families are suing Southern Company Services and Georgia Power Company because they built the 60 foot utility pole that the NTSB says tore off the wing of the plane before it crashed.

Milliken and Company is named as a defendant because they allowed the power pole to go up on their property.  

The city of Thomson and McDuffie County are being sued because they own the airport. According to the lawsuits, they were supposed to keep structures from being built that could interfere with aircraft.

Spirit Aviation Inc., which operates the airport, and the airport itself are also being sued because the lawsuits claim they were responsible for fixing issues that could affect the safety of the public.

The Sky's The Limit Inc. employed the pilots and they're a defendant in the case because the lawsuit says they were responsible for safe operation of the plane.

None of the defendants or lawyers are commenting on the lawsuits yet but Davidson's lawyer says he's never seen a case where so many people are responsible.

The victim's families don't want to talk about the litigation; but Volpitto's son Scott says at the very least finding out the exact cause of the crash will be helpful for their family.

The victims' families aren't saying if they're working together but there are several things that point to a group effort.

All the lawsuits were filed the same day in Fulton County and all of them requested a jury trial.

Two of the families, the Porters and McCorkles, have the same lawyer.
