All judges in Macon Co. recuse themselves from Victoryland case

TUSCALOOSA, AL (WSFA) -

The Alabama Supreme Court must now appoint a new judge to oversee the case between the State of Alabama and Victoryland in an ongoing legal battle over whether the Macon County gaming facility's machines are legal.

The decision will have to be made because all judges in the 5th Judicial Circuit, which encompasses Macon County, have recused themselves from the case.

Circuit Judge Tom Young, Jr. was ordered by the Supreme Court in August 2013 to step aside from the case following protests from Attorney General Luther Strange's office that Judge Young had prejudiced himself for Victoryland and against the State.

Attorney's for Victoryland owner Milton McGregor were disappointed with Young's removal, accusing the Attorney General's office of "judge shopping" to reach a favorable ruling.

After Young's removal, the case was handed to the next senior judge, Ray Martin, who disqualified himself. Judge Martin then notified the next senior judge, Steve Perryman, who also deemed himself disqualified.

Judge Perryman then notified Macon County District Judge Aubrey Ford, who is temporarily assigned to sit as a Circuit Judge when necessary, but Judge Ford then recused himself because he's had involvement in the past with one of the charities that was supported by Victoryland.

Following Judge Ford's determination of disqualification, Judge Tom Young has directed the Circuit Clerk of Macon County to notify the Administrative Office of Courts that all judges within the circuit have recused themselves.
