Holmes to change plea to guilty by reason of insanity

DENVER (RNN) – Attorneys for James Holmes plan to change his plea from not guilty to not guilty by reason of insanity.

Holmes is accused of killing 12 people and injuring 70 at an Aurora, CO movie theater during a midnight showing of The Dark Knight Rises on July 20, 2012.

Police also found explosives and traps set at Holmes' apartment.

If the judge accepts the change in the plea, he will be sent to a state mental hospital for evaluation.

The Associated Press reports a jury could still find Holmes guilty even if doctors determine Holmes was insane at the time of the shooting.
