CINCINNATI, OH (FOX19) -
The estate of David Hebert, who was shot and killed by Cincinnati police in April of 2011, has expended a wrongful death lawsuit to include other officers and the City of Cincinnati.
Hebert, also known as 'Bones,' was shot on April 18, 2011 by Officer Andrew Mitchell.
Police were called to investigate an altercation that had occurred between Hebert and a friend. They found Hebert with a female companion, and he was intoxicated and had trouble standing. Police say Bones swiped a switchblade at officers and that's why Officer Mitchell shot him.
Last year, Hebert's estate filed a wrongful death lawsuit against Officer Mitchell. Now, that suit has been expanded to include the City of Cincinnati, as well as three other officers who responded to the scene.
The suit claims "deliberate indifference of the responding officers to the sufficiently serious medical needs of Mr. Hebert."
The lawsuit seeks punitive and compensatory damages.
