Complaint details money, machines seized from VictoryLand

SHORTER, AL (WSFA) -

VictoryLand and its attorneys have 30 days to respond to the official complaint filed by Attorney General Luther Strange demanding that the profits and machines seized from the facility in the Feb. 19 raid be forfeited and destroyed.

The complaint and attached inventory listing states $223,405.86 and 1,615 "Electronic Gambling Devices and related property" were seized from the facility during a raid on February 19.

The state is demanding the listed "contraband" should be forfeited to the State of Alabama for destruction or otherwise disposed of by the Court's decision due to the fact that the cash and machines were fruits of a crime.

Attorney General Strange wrote in the complaint, "The above described gambling equipment along with evidence and records relating to illegal gambling, and other equipment in possession of said Respondent Victoryland constitutes illegal gambling devices, slot machines, and gambling records possession in violation of the State Law of Alabama."

The complaint also states the cost of the proceedings in the case be taxed against VictoryLand.

VictoryLand has 30 days to respond to the complaint which was filed on Monday, Feb. 25. Court documents show the case has been assigned to Alabama Circuit Court Judge Tom Young, who stated he reluctantly signed the original search warrant that allowed the Feb. 19 raid.

The seized items listed are currently in custody of the State of Alabama and documents state they have been secured under the direction of Attorney General Strange.
