MONTGOMERY, AL (WSFA) -

One day after it was learned former Alabama Agriculture Commissioner candidate Dale Peterson has an arrest record, Peterson spoke with a Birmingham talk radio station in an effort to set the record straight.

Peterson was taken into custody on October 1, 2012 after allegedly shoplifting at an area Wal-Mart. Peterson was booked under the name Roger Peterson, reports WBRC Fox 6.

Peterson was taken into custody by for theft 3rd degree at the Wal-Mart on U.S. Highway 150 in Hoover just outside of Birmingham. Police say Peterson pushed a shopping cart with beer and paper towels beyond the cash register without paying for the items.

Peterson told WAPI-FM that he was simply going to the restroom and had every intention of paying for the items. He said store security stopped him as he came out of the restroom.

His unique campaign commercials to become Alabama Ag. Commissioner, riding a horse and carrying a gun while telling potential voters he was going to go after "thugs and criminals", went viral online. Peterson's campaign, however, was ultimately unsuccessful.

Peterson was last in the news in January, issuing a statement saying he was declining a job offer from the man who beat him to become Ag. Commissioner. Peterson said the job offer was a scam, designed to neutralize him from any potential run in the future. Commissioner John McMillan has denied Peterson's claims.
