Governor McDonnell's plan to fund Virginia roads is now in jeopardy.
The governor wants to overhaul how we pay for fixing our roads, but it would have been a tough fight in the evenly divided Senate.
Almost as close as it can get to the last minute, a new proposal has been drawn up, so something can be done.
Tuesday night is the deadline to shape the future of transportation in Virginia. Governor McDonnell's original plan wanted to get rid of the gas tax, and increase Virginia's sales tax to build new roads.
The senator who was supposed to support McDonnell's plan, now has a plan of his own. That would be Republican Stephen Newman of Lynchburg. Like McDonnell, he wants to get rid of the gas tax, but he wants to replace it with something new. He wants a 5.5% tax on fuel that would change as fuel prices change.
Senator Newman says the plan would bring in at least $500 million for roads by 2018, but critics say that's not enough to pay for roads.
Attorney General Ken Cuccinelli, who's running for governor, urged lawmakers to pass this new plan. The house already passed the governor's overhaul, with an important provision that gets rid of tolls on I-95 south of Fredericksburg.
