Warrant issued for Regency Mall property agent based on "confusion"

It would seem a property agent with Augusta's vacant Regency Mall is in trouble.

An Augusta judge issued a bench warrant for Mark Axler after Axler failed to appear at a Thursday hearing regarding code enforcement citations with the mall.

Rob Sherman with Augusta License and Inspections Department says it's all a misunderstanding though.

Sherman says the purpose of the hearing was to extend the deadline the city gave Axler to comply with the citations. He says Axler was in Florida, and both parties incorrectly believed another agent could stand in for him.

"It's confusion and a mistake on our part that he couldn't do that, that the person actually cited had to appear in court," Sherman says.

Cinder blocks cut off every possible entrance to the Regency Mall. That was just one of the regulations Axler and the mall had to meet.

But Sherman says Axler has done everything he's been asked and more.

"[The mall] will be entirely secure," Sherman says. "They have removed all the shrubbery. They've got workers over there cleaning up."

Sherman says his office is pleased with the progress made on the vacant property, and they will work to get Thursday's misunderstanding corrected.

"We'll get in touch with the judge and the court and find out exactly what we need to do," he says.
