Wrongful death lawsuit filed against Andrea Sneiderman, Hemy Neuman

ATLANTA (CBS46) -

A wrongful death lawsuit has been filed against Andrea Sneiderman and Hemy Neuman for the death of Andrea's husband, Rusty Sneiderman.

The civil suit was filed Friday in Fulton County Superior Court by Rusty Sneiderman's brother, Steven Sneiderman, on behalf of Rusty and Andrea's two children.

It alleges Andrea had an affair with Neuman and conspired with him to kill Rusty. The suit asks for the couple's assets to go to the children, and for a jury to award damages.

"Steve Sneiderman has filed it (civil lawsuit) for the protection of his brother's children. It's that plain and simple," said Bill Ballard, attorney for Steven Sneiderman.

John Petrey, who is one of the attorneys representing Andrea, said the suit is only hurting the children.

"I think when all the facts are on the record everyone will understand why the suit was filed," Ballard said.

In April, a jury found Neuman guilty but mentally ill for murdering Rusty Sneiderman outside a daycare center in Dunwoody in November, 2010.

Neuman admitted that he gunned down Rusty Sneiderman, but had pleaded not guilty by reason of insanity. 

Neuman was having a reported affair with Andrea Sneiderman at the time, with whom he worked. During his trial, both sides questioned Andrea's involvement. She has not been charged criminally.

"No one wanted Andrea Sneiderman to come out looking good from that trial. It didn't fit anyone's agenda. The only good thing out of this suit is it's the first opportunity for Andrea to have in a public forum make the real Andrea Sneiderman to be known," Petrey said.

Ballard said the civil suit is about truth and justice.

"The Sneidermans and I are very eager to hear that story and have it all out there," Ballard said.

On Friday, one of Andrea Sneiderman's attorneys, Douglas Chalmers Jr., release a statement on his client's behalf, which read:

"Steven Sneiderman and his attorney Esther Panitch have been attempting to try Andrea in the media for months. We look forward to vigorously representing her in a court of law where, for the first time, she will have the opportunity to tell her side of the story. We are also carefully considering our legal options regarding the outrageous and libelous statements that have been made to the media about Andrea, without the benefit of privilege, by various individuals."
